Once again, the OTW and EFF persuaded the copyright office to grant vidders (and other makers of noncommercial remix video) a DMCA exemption! The Librarian of Congress 1) renewed the existing exemptions (which allow us to circumvent DRM on DVDs and digital downloads) and 2) added Blu-Ray.

I listened to a presentation this week from a librarian (a Canadian librarian who therefore possibly is not 100% up on the DMCA or the exemption process) talking about the difficulties the DMCA/copyright cause libraries (inability to serve as a true archive for ebooks and other digital materials, inability to make ebooks screen-readable for visually impaired patrons, etc) and she sort of mentioned that DMCA exemptions are theoretically possible but then immediately dismissed that as a route for libraries to pursue. I'm sure it's a whole other kettle of fish and obviously not easy, but I was still like "But I KNOW PEOPLE who get DMCA exemptions for stuff! WHY ARE WE NOT WORKING ON THAT?"

Which is to say. YAY GOOD WORK OTW LEGAL!

That's honestly the part that really blows my mind--the ALA is a thing! Kind of a big deal really! Major national organization, probably with some lawyers on staff somewhere! WHY IS THE ALA NOT GOING IN FRONT OF CONGRESS AND MAKING THEM PUBLICLY SAY NO TO NICE LIBRARIANS IF THEY WANT TO DENY THESE EXEMPTIONS? But this is the part where I tell myself that surely the ALA has indeed thought of this and has some sort of compelling reason not to. Just... a secret compelling reason, maybe? IDK.

I don't know what specific library issues or activities the presenter you saw was discussing, but I can tell you that the ALA and other major library associations are actively involved in the DMCA and other copyright and intellectual property law-making and rule-making processes via the Library Copyright Alliance, which submitted comments on several proposed exemptions in the most recent round of DMCA exemptions. Are there more or different things for which the library profession should be advocating in this arena? Maybe so, but we do have the advocacy infrastructure in place.

Aha! Possibly just a thing our presenter was not up on, then. (She was, uh, mainly talking about ways to get AROUND copyright law in a library rather than ways to, you know, change it?) Good to know that the ALA is indeed on the job there. *g*
